XM Must Defend Copyright Suit by Recording Industry (Update3)

Jan. 19 (Bloomberg) -- XM Satellite Radio Inc., the biggest U.S. provider of pay-radio service, must defend a copyright infringement lawsuit brought by record labels owned by Sony BMG Music Entertainment, EMI Group Plc and others, a judge ruled.
The suit by the 10 labels is over an XM service called XM+MP3 that allows users to download permanent libraries of songs. Because subscribers of Washington-based XM are able to store these songs, the record labels say, consumers will have ``little need ever again'' to purchase the songs from them.
