KFRH-FM North Las Vegas sold

The receiver has sold KREV-FM Alameda as well as KRCK-FM, Mecca and KFRH-FM North Las Vegas to VCY America Inc. The stations will be changed to Non-Commercial operation. VCY is a religious operation based in Milwaukee. VCY America. The selling price for all three is $6,000,000.00
 
Two weeks after a federal court in Los Angeles ordered station owner Ed Stolz to be jailed for failing to turn over the financial records, other documents, and building keys to his stations, Judge Jesus Bernal says Stolz is “now a fugitive from justice.” He has imposed a $10,000 per day fine against Stolz for each day he does not surrender, beginning with the issuing of the order on Wednesday.

Earlier this month the court issued a warrant for Stolz’s arrest, charging him with contempt of court for violating a court order in connection with the looming sale of a trio of FMs secured by receiver Larry Patrick. Stolz had unsuccessfully argued that he had met all the requirements Bernal had put on him. Those included providing Patrick with all the bank account information and statements, tax identification numbers, payroll records, station website hosting company information, and office keys. Stolz also accused Patrick of only trying to “create enough smoke and confusion to recklessly cause Edward Stolz’s life work be taken away from him.”

But since that threat of arrest, Bernal said little has changed. “Stolz continues to fail to comply with this court’s orders,” he wrote in an order released Wednesday. “Specifically, he has failed to sign operational control of the bank accounts belonging to the radio stations at issue over to the receiver and to provide the receiver with all financial paperwork necessary for the receiver to run the stations, including identifying information regarding past accountants and copies of the stations’ 2019 federal and state tax returns.”

Instead, Stolz has submitted several court filings in recent days attempting to get the court to dismiss Patrick as the receiver. It is a move that both Patrick and San Francisco tower owner Bellaire Tower Homeowners Association have argued should be rejected.


Bellaire Tower earlier said it supported the sale of the Stolz stations since it has not been paid for the tower site used by CHR “92.7 The Revolution” KREV San Francisco. It is asking a federal court judge to award the company $305,940 from the pending $6 million sale of KREV and sisters“104.3 Now” KFRH Las Vegas and “Hot Hits 97.7” KRCK-FM Palm Springs, CA to religious broadcaster VCY America.

In addition to fighting in court, Stolz and Patrick are also facing off at the Federal Communications Commission. Stolz has asked the FCC to reject the proposed sale of the three FMs to VCY America. But Patrick has accused him of trying to "to obfuscate the facts" and use the FCC "as a pawn" in his years-long effort to block the court's judgement. "It is not the role of the Commission to second-guess a Federal judge’s orders or to inject itself into what is, at its core, a private dispute," said Patrick in his filing.

Patrick likely has precedent on his side. The Commission in the past has typically left such disputes to the courts, only stepping in when agency rules have been violated.
