The apology does not affect the course of the investigation, said Mary Catherine Kilday, FCC assistant chief of enforcement, but would likely be taken into account if the commission decided to take action against the station

I don't think he implied anything about Bean in his posts; that was just a desperate diversionary tactic you deployed, but as long as you are going to go there, ouch, he just played the "Bean actually has a documented history of hoaxing (about murder no less) and thus may not be your best source of 'research' card".

Sometimes one needs to quit while they are way behind, and for you KMR, now would be that time.
 
Last year I wrote a story about that Kevin & Bean "murder confession" hoax for LARadio.com but Don Barrett rejected it, saying he did not want to resurrect such a negative story. Nobody ever saw that Rewind feature.....until now:

LARadio Rewind: June 13, 1990. KROQ morning hosts Kevin Ryder and Gene "Bean" Baxter take listener phone calls during a "Confess Your Crime" segment. One caller admitted to beating his girlfriend to death. The confession led to an investigation by a Los Angeles Sheriff's Department homicide investigator and was featured on NBC's Unsolved Mysteries program. After ten months, it was revealed that Kevin and Bean had arranged for KZZP-Phoenix dj Doug Roberts to make the "confession." (Kevin and Bean had worked at KZZP in 1988-89.) All three were suspended for five days and Kevin and Bean were ordered to perform community service and reimburse the Sheriffs Department for the costs of the investigation. Roberts, also known as Sluggo and as Doug the Slug, would join KROQ's airstaff in 1992.
 
And almost 25 years later, that is supposed to be the reason I should not have taken Bean Baxter at his word for saying on the air that there would be no news.

It would be one thing if he -- if either of them -- were habitual about being less than truthful on the air. But if you have to go back a quarter of a century to "prove" I was wrong to base a prediction on that on-air statement, then the phrase "grasping at straws" just got new meaning. Documented history? More like documented incident.

This has stopped being about my prediction. That stopped being valid when Weatherly made the announcement about MacKay. Anyone who wasn't still hell-bent on attacking me over anything they can find would have written it off based on being made before the invalidating announcement. Whatever your perceived past problems are with me, get over them and stop using them as justification for posting what amount to character assassinations. (TOS, paragraph 5, sub-paragraph 1 ... the words "abusive", "harassing", "defamatory", "libelous" and "hateful" all are applying to the tone and content of your posts.)

And Flipper, I'm going to remind you one more time. You are neither a moderator nor my mother. Back off with the advice.
 
At times like this we reflect on how truly fortunate the radio world is that you are no longer a part of the moderation team, at least here. Perhaps you can start your own forum someday and once again enjoy the power you seem to derive from posting your mindless commands. Please KM, don't tell Flipper or Steve or me Scott what to do or think. You are not our Mother nor a moderator. No one has violated any acts of the terms of service against you. You are a pain and we wish you would stop. If you want to post here great. If you want to post erroneous statements take them like the man we all know you to be.

He has stated as much publicly as well, so it is no secret that in his signature is a paid for banner ad (that is available to anyone else who is interested in supporting the site financially).

Character assassination is not allowed, and THAT is what you have been and are trying to do. Many, if not most of the events YOU complain about regarding KMs moderation period are ANCIENT history. YOU need to let it go. This is my ONLY warning that any further attempts to harass KM will result in a suspension because harassment of this kind is unacceptable, and the "target" has issued several complaints.

Then, just one day later, she makes an ill-informed prediction regarding the KROQ morning show, which was shot down with documented facts the very same day. In response she lashes out against every poster who comments on the situation, including putting words in a fellow poster's mouth of accusing a local radio personality of being a liar, which was not at all what the poster posted, and lastly, ridiculously calling out anyone who posted regarding the subject (all of whom are long-time, respected posters) as being hateful and harassing while never admitting her actual error in her original post nor acknowledging the fact that she had been hoisted by her own petard.

After all of that, management comes down on the side of one of the most arrogant and antagonistic posters who has ever typed on this site because she has purchased an ad and has made previous (one presumes, just as weak) accusations.

How much was the ad that bought off your judgement in this case?
 
It has be both ways, moderators. We feel belittled many times here when it comes to the fans and the pros.....once again, whoever they are. You have to maintain balance here on these boards. It's not all about the pros here. Many fans post here and they have the right to express themselves as well. Or as was mentioned on that Rock/Classic Rock thread, some of us will leave for good.

Heck, if us music fans donated a million bucks, we'd still get kicked around.

No one should get preference. We're all posters here.

Its not preference - its civility. On another forum on this site I took a poster to task for ad hominem attacks on David Eduardo, a man I've never met but come to respect.There was a resason why I did so.

Everyone is entitled to their opinions on anything and anyone can choose to disagree with those opinions as well. But when you move from discussing opinions to attacking an individual the referees have the right (duty) to step in and say "quit it." The alternative is not what anyone (at least in my belief) wants.

And yes, everyone's right to express themselves within the guidelines of the venue should be equally supported. If non-professionals in radio (and I'm one of them) feel personally belittled they should complain to the moderators and be responded to. I've not felt that reminders about the weaknesses of free ratings demographics constitute personal attacks and so haven't responded or complained. That said there are different groups here and the professionals and non-professionals both need to respect the others.

KM did not "berate" the "fellow poster". It was just KMs own advice. And considering you do not take much credence in what KM writes, it is very easy to just IGNORE the comments.

Hmm .. from my understanding the "ill informed prediction" was made because of something an ill informed host said. But the FACT that KM has admitted the error in the "prediction" shows me that KM has a better bearing on what is happening because you continue to chide KM for things no longer relevant (regarding being a moderator YEARS ago, almost a decade!). So YOU tell me how much I was "bought off"?

It's aggravating that the "fans" complain to me about the pros doing things they (the fans) do themselves. You all (fans) have complained about the pros being "hateful and harassing".. AND YET, what is happening HERE? The exact same thing. I'm telling ALL of you, treat others the way you want to be treated, not the way you are treated. Incidentally, YOU may not respect KM, but KM is ALSO a well respected, long time poster.

KMs remark about the "fellow poster" calling the host a liar was more tongue-in-cheek than an actual accusation. HOWEVER, the "fellow poster" essentially DID call the local personality a liar, by insinuating that we shouldn't believe everything we hear or read. Let me explain further: If you shouldn't believe what you hear or read, and the host says something that turns out to be not true (because the host did not have all the facts at the time of the announcement) then, one can safely assume you mean to call the host a liar. We all in our BETTER JUDGEMENT know that the host was not lying, but was misinformed. You MUST be careful how you choose to phrase things. I am a stickler for context and semantics.

When COMPLAINTS or REPORTED POSTS are filed, we review and take action as necessary. THIS is an instance where action is being taken.

Now if this tit-for-tat continues EVERYONE involved will be on suspension. SO ... I STRONGLY ADVISE that EVERYONE move on. I (nor Frank) will babysit you. If you have further complains about how this is being handled, PM or email me. Further posts about this "action taken" will be deleted.

Now we read in L.A. Radio about Death threats and Rape with the KROQ morning show. Sounds like another one of those Kevin & Bean hoax's?

(March 2, 2015) Death threats, forewarnings of rape. Sounds more like a reality tv show than radio. The drama started when Lisa May was fired from her 24-year job doing morning traffic on the Kevin & Bean Show at KROQ. Within hours it was announced that former KTLA/Channel 5 Morning News at-large feature reporter Allie MacKay would be joining the popular duo, the negatives on social media started with a flurry. The timing and execution of the hiring and firing was poorly done. Kevin & Bean, along with their program director Kevin Weatherly, have been contemplating ways to jump start their morning show with a fresh, new approach. They looked at the features currently airing and determined that their listeners no longer went to the show for traffic and news. Looking back this doesn't sound like an announcer was out of the loop or il informed to me?
 
I stepped in because of you (and others) attempted character assassination on KM. Whether the announcer was or was not ill informed is not relevant.

Let's review:

New trend in the industry, referenced in the Barrett article this morning. Morning shows no longer "need" news and traffic reports, as more and more people rely on smartphone applications and the Net. If they are using radio the tendency is to tune in the all-news station rather than expect it on your music station. ... but I'm fairly confident that will be the outcome given today's realities.

"Fairly confident" is not the same thing as "predicting".

There goes KM's short lived streak of predictions...

Perhaps you should be chiding Mr. Baxter for either not knowing what his corporate masters were doing ("left hand, meet right hand") or misspeaking himself.

No, he DID get the best of you again. Your prediction, which would have taken at least three months to verify, was effectively shot down within three hours. But don't worry, your reputation for making bad predictions has not gotten any worse in my book.

Well, that was yesterday. My prediction which everyone seems so overjoyed to trash me over was based on remarks made on the air during Friday's K&B show. Had Kevin Weatherly told Bean this was going to happen, he would not have said what he said ("there is no news") and I wouldn't have said what I said based on that.

Just stop predicting like you are the all knowing 'Mystic Seer' which at least requires a Penny. No one is out to trash you or prove you wrong. If you actually believe everything you hear or read, your "research" as you refer to is no doubt flawed. When you make assumptions and or portend to speak from a voice of authority you are bound to be wrong from time to time. Let it go KM, many of us don't take you that seriously anyway!

So, after all that you and Channel Flipper now concede that KM was correct in the assessment that listeners no longer need news and traffic reports, and THAT was the basis for the changes?

I don't though, this was a simple lineup change. Things get stale, ratings falter. I never called anyone a liar and I never assassinated anyone. I might of Ad Hominime'd someone but I still don't know what that means? KMR was speaking from a consultants point of view saying a Broadcast team or a traffic reporter, or a news person isn't needed in today's Radio, that just isn't true. I don't have a smart phone or any devices which can tell me about Deadly crashes ahead, or the weather or news unless I want to tune away? That is the last thing the Broadcast station would want you to do?

Now I see that her ad has bought that and so much more - the chat room equivalent of the judge and jury serving as her own defense attorney and advocate. Nice! Like most attorneys, you argue her case better than she does. She fires first, aims later, and has you come afterwards to clean up the mess.

Point 1 - You argue that she did not make a prediction, but used the term "fairly confident", which you imply is something different. Your own client has refuted that by writing "My prediction was based on what Bean said on the air Friday morning"

Point 2 - KMR cannot effectively argue her own point. She points out that her last successful prediction was regarding the demise of Indie 103.1, a prediction that virtually anyone who knows anything about local radio that was not an Indie fanboy also made. Not a very good defense of the recent prediction. How many years ago did Indie go away?

Point 3 - While it is true that it now appears that news and traffic will be eliminated from the Kevin and Bean show, as documented by LARadio.com today, the show participants and CBS management have not turned out to be not entirely reliable sources of information, both on air and off, which as HotHits posted, is consistent with the lies and falsehoods that Kevin and Bean have perpetrated on their own audience in the past. It is actually HotHits' assertion that Kevin and Bean's on air comments are not a good source of "research" which has been vindicated, as Kevin and Bean were not completely honest with their audience again. Turns out that lies told over twenty years ago, and the reputations they damaged, ARE relevant today. CBS management Kevin and Bean have successfully managed to piss off their audience over the replacement of small players. Character counts, then and now!

A self-professed radio expert such as KMR should know that bit players on successful talk shows have almost zero affect on ratings, one way or the other. If the situation was handled properly, the replacement of the bit players on the show would have quickly been a non-issue and the ratings effect would be negligible at best - just as it has been in the past when very talented, but bit players nevertheless, like Jimmy Kimmel and Adam Carolla left the show. For KMR to spout off that she predicts a big ratings increase shows that KMR is probably not the programming expert she proclaims to be, even with her vast amount of experience in the industry (and thus my original admonition to her regarding her bold prediction).

The ratings will stay flat (defined as being within David E's. somewhat nebulous definition of a "wobble") or may decrease a bit due to the very poor manner in which CBS management has handled the whole episode. Unlike KMR, I am man enough to stand by my predictions right or wrong, and if other posters take shots at me for being ill-informed or flat out incorrect, I will not make libelous reports of them to the moderation team with false and defamatory accusations of hatefulness and harassment.

You've unfortunately become so self-absorbed in your attempts to put me down that you failed to realize my comment on the Indie prediction was tongue-in-cheek. Or did you miss the :rolleyes: smiley afterwards?

Now hold on there, sir. My first reaction to the situation was shock. Go back and read post #2. Yes, I did say in post #11 that "the ratings will go up" but I certainly didn't say "big ratings increase". And I based this on trends in the industry, including (as I pointed out) that the station in the next studio over at Venice and Fairfax has never had news in ten years of its current format.

I am in complete agreement with you that the bit players themselves don't really matter. That is why, except for my dismay at Boyd being let go after all these years (a single comment within the discussion), my comments and opinions were based on the content, not the actual people providing the content. Again, read #11. Did I mention the bit players by name? No, I did not.

I also agree with you that the situation was not handled well by Kevin Weatherly or anyone else at CBS. Had it been, we would not be arguing these points in the first place.

You are confusing "standing by one's predictions" with "retracting one's opinions when new facts surface". There is a huge difference. And I did make a statement after the second Weatherly announcement in that vein, did I not? (#15)

As long as you're going to make accusations about intent: I similarly perceive that you make mountains out of molehills by taking any misstatement I make -- even if subsequently retracted or otherwise admitted to be in error due to subsequent revelations -- to go after me. That is what has to stop.

The whole reason we are having THIS discussion stems from you and Hot Hits condemning and ridiculing KM for having the opinion (one that has been misstated as a prediction.. even if KM indulged you) that news and traffic would be pulled from the station in question.. THAT observation from KM apparently was correct, as Hot Hits even quoted another source stating as much (I guess HH did not really understand it vindicates KMs opinion on the matter). If you are truly man enough ChannelFlipper, where is your apology to KM?

My judgement has not been bought, and that is a harassing, libelous statement because it is not valid. The facts are there, as I present them and stand on their own. You got dragged into this because of choice comments you made against KM. A third party website has essentially vindicated what KM initially said and that you and Hot Hits criticized. While I do have a vested interest in keeping KM as a client, KM would not ask me to lie, nor would I lie or taint my judgement in order for her to stay on as a client. Now if you are going to post libel against me by continuing to say my judgement is impaired and has been bought, there will be further legal repercussions. I also expect a public apology.
