The podcast studio Tenderfoot TV has filed a breach of contract lawsuit against Audacy’s Cadence13 alleging the company failed to make a scheduled payment due under its long-term sales contract for selling ads on shows like Up and Vanished, To Live and Die in LA, Rattled & Shook, and Radio Rental. In a lawsuit filed in U.S. District Court in Los Angeles, Tenderfoot alleges it received notice from Audacy earlier this month that it was “suspending further performance of C13's payment obligations” on a contract inked by the two companies. It says the August installment payment totaled $520,833.
Court filings show the deal requires Cadence13 to pay Tenderfoot TV a minimum guarantee of $14 million over the first two years of the contract that began on Jan. 1, with a minimum guarantee jumping to $21 million across the three-year agreement that runs through Dec. 2025. In addition to the August payment, Tenderfoot TV is also seeking interest, legal fees, and other unspecified damages.
