Casey's Top 40 not allowed to be streamed?

Does Premiere Radio not allow stations to stream Casey's Top 40? I was listening to our local Oldies Station Kool Radio on Tune-in. Greatest Hits USA was on til 9PM followed by Westwood One News. After the commercials that accompany Westwood One's top of the hour news the stream switched to non-stop Public Service Announcements while over Kool Radio's terrestrial signal on 990-AM and 96.1 FM they are running Casey's Top 40 The 70s like every Sunday Night at 9PM.

It's possible that the local station doesn't want to risk getting sued for playing pre-1972 music. That's only an issue for digital, not broadcast, airplay. Stations are responsible for paying royalties on their stream, not TuneIn.

That will probably change if Congress approves the Music Modernization Act, that will cover pre-1972 music.

The station in question still plays quite a bit of pre-1972 music during its regular programming, and all of it is streamed, so that theory seems unlikely.
 
I'd have no idea why this station isn't streaming the AT40 reruns, as hundreds of stations stream the show, as well as a dedicate channel on the iHeart radio app. "Casey's Top 40" by the way is an entirely different show than American Top 40. Casey's Top 40 picked up after Casey left American Top 40 in 1988. Those shows aren't being syndicated
 
Casey is now starring with Shadoe Stevens on IFC Movie Promos. Good to see him again!
