The rules are that the FM translator operation must adhere to the operation of the AM primary station. If the primary station is off the air, the translator should also be off the air, or at the very least, request special permission to operate without the AM for a temporary period of time specified by the FCC. The only exception is if the AM station is a sunrise to sunset daytime only operation but 1310 has nighttime power, albeit, limited. The FCC will allow a daytime AM's translator to operate during hours the AM is off the air at night due to its license limitation. The 890 AM is an example of a daytime only AM.
