SiriusXM Radio is wrapping the year with another lawsuit for a claim of unwanted marketing telephone calls that violate the Telephone Consumer Protection Act. Filed as a civil complaint Dec. 27 in the U.S. District Court for the Eastern District of Michigan, Flint resident Nyla Dalrymple claims that nearly three dozen calls merit her at least $46,500 in damages.

The lawsuit follows similar complaints that accuse the satcaster of robocalls without consent. In November, two San Diego residents filed a class action suit citing violation of the Driver Privacy Protection Act. And in both February and March, class action suits were filed in Texas, for alleged violations of the Telephone Consumer Protection Act, which forbids telemarketing robocalls.

In the December lawsuit, 73-year-old Dalrymple claims that she began receiving calls to her cell phone in August 2017 from SiriusXM. According to court papers obtained by Inside Radio, she “was unaware as to why Defendant was contacting her, as she does not subscribe to Defendant’s services.” Further, when she answered calls from SiriusXM, she would hear a pre-recorded message before she was connected with a live operator, soliciting her to subscribe to satellite radio.

According to the lawsuit, Dalrymple said she was not interested and demanded that SiriusXM stop contacting her, however, “despite Plaintiff’s demands, Defendant continued to systematically call her cellular phone well into the fall of 2017. Plaintiff has received not less than 31 phone calls from Defendant after demanding that it stop contacting her.”
