Thought you might be interested in this thread from the Seattle Board. The discussion has national implications and is related to the recent decision in Sells, AZ (currently on appeal) that says backfilled vacant allotments are no cure or remedy for actual radio service. This has implications for the Tuscan market, Portland Oregon market, Eastern Oregon, Southern Washington markets and the Seattle-Tacoma market (02-136). In Sells, AZ (02-376), petitioner is trying to "move-in" to Tuscan by way of an air force base, claiming that it is a "city". What a joke. So check this out, especially you FCC Staff out there:

You'll see that these guys, in their desperation, bought an allotment in Condon, Oregon (pop. 745) as a hedge against a non-favorable ruling in Sells, AZ. Yet in RM-10960, First Broadcasting states on page 23, 2nd paragraph that stations in low population areas are not viable and they will not build them out. Yet, they actually have a construction permit for KHAL, Condon, Oregon (pop 745). But we know darn well that this is s stooge allotment and First won't build this out....they have three years, and they'll be long gone with their sack of money from the Covington (Seattle-Tacoma) move-in.

That is correct, though the owner of KMCQ, The Dalles(OR) has co-signed the FCC filing, so that element is kosher. However the larger issue with the Condon, Oregon construction permit is that it is contigent upon at least four, maybe five pending proposals which might make this allocation moot. So, if Sells, AZ. is not favorable, and the CP in Condon won't get rid of any "white" area ie. area of no radio service due to the the pending nature of the other applications in the area on that particular channel, then First Broadcasting has Docket 05-210 "Streamlining FM rules" to fall back on. But what they should do is cut a sweetheart deal with KMIH as KMIH will remove their Petition of Reconsideration assuming they can get back to the reserved band, which might be possible with a waiver. So if I were First, I'd would get on this immediately and be done with it.
