KUSF Supporters May Have Valid Reasons to Deny Sale...

I just took a look at the Petition to Deny made by the Friends of KUSF group asking the FCC to deny the sale of what is still KUSF to Classical Public Radio Network (which has stated that they don't consider Friends of KUSF a valid petitioner) and although there is a lot of the same programming arguments made by the supporters of KTRU in Houston that the FCC has washed their hands of ever since WEFM and WNCN, there are a couple of valid things that the FCC could use to void the sale:

1. Since the LMA of KUSF and KNDL to CPRN, they seem to have not been giving legal IDs consistently at the top of the hour (which right now would be "KUSF San Francisco, KNDL Angwin-Santa Rosa" or "KNDL Angwin"). Although the examples transcribed seem to be over-concerned with the announcers frequently dropping the KDFC calls (and the general informality of KDFC announcers compared to old-school classical music radio announcers), there seems to be evidence that the legals have not been consistently given since the switch. CPRN has responded that "KDFC" is the station branding and is nothing different than Z100, Q101, the Band or Energy 92 (or, for a non-com example, the Current in the Twin Cities or K-JAZZ in LA).

2. What could be more damning is that they claim that in several visits to the USF campus to view the KUSF public file, there is no evidence of the non-com equivalent of an LMA between USF and CPRN. (They also claim that USF personnel tried to keep them away from the public file and tried to force them to sign in before viewing, which they claim is in violation of FCC regs involving viewing of station public files.)

Personally, I still think in the end if the FCC turns down the sale, USF will just re-sign another LMA with CPRN while giving the KUSF gang the Jesuit version of the middle finger.
 
I can't argue with the second point, but in regard to legal IDs - every thread I've ever read on this topic (and there have been many) point to the fact that it's not unusual for stations to skip the legal ID, and nobody (including the FCC) cares. In the unlikely event that the FCC even notices, the remedy would be for the FCC to order the station to start announcing the legal ID. Nothing more than that.
 
They do the accurate legal ID but it is pretty much a throwaway. The lack of documentation in the public file shows somebody isn't on top of things. Does KDFC have to keep the Public File in their building or should it be at the original KUSF studios?
But do the Friends have any standing beyond just concerned citizens whose remarks are always importanat to the FCC?

This is 100% BS. I happen to be a listener to 90.3 now that they've expanded their playlist and have more interesting music. The ID's are recorded and play within 2 to 4 minutes of the top of each hour, usually just before the hour. They ID KUSF, KNDL, and the two KNDL translators (which they don't even need to do hourly) along with proper city of license.

They've pretty much got it together now, but they didn't at first. The public file thing is the real killer. But this could backfire. Wouldn't the present owners be responsible for the public file, and thus be the ones who are negligent?

Even if the sale doesn't go through, its not like 90.3 will become KUSF again, and 89.9 will become The Candle again. CPRN will just set up a long term LMA

KNDL's safe no matter what. The Friends of KUSF don't care about KNDL--in fact, the fact that the KDFC calls are going to 89.9 instead of 90.3 seems to me an indication that CPRN is thinking that they might lose KUSF, although it's unlikely.

What about the 3rd station KDFC has been talking about the one in San Jose has that LMA been set up or is this still being talked about for now.
